Commission News: June 2022

Dear friends,

An opportunity for new conversations

The federal election has come and gone, and we have a new Government. This provides an opportunity for a renewed conversation on the promotion and protection of human rights in Australia, and the crucial role that the Commission plays in the domestic implementation of the commitments of Australian governments, from both sides of politics, to the world. New governments have crowded agendas, so our advocacy and the support of all our friends, will be singularly important.

For the Commission, it is essential to our work that we are provided an appropriate level of funding to discharge our wide mandate; and it is essential that we secure enduring change to the manner of appointments to the Commission so that we can be re-accredited as an ‘A status’ national human rights institution.

This is not just a matter of our standing in the international community, but also of our nation. Australia led the advocacy in relation to the importance of independent NHRIs and co-sponsors the UN resolutions in defence of independent NHRIs and human rights defenders.

This advocacy has been a defining and enduring contribution by Australia to human rights protection, and significantly affects the positive regard in which Australia is held in the Human Rights Council and General Assembly. This is not a time to put that in peril. It is the time to enhance it.

I look forward to discussions with the new Government and the Attorney-General, the Hon Mark Dreyfus QC MP, with whom I worked when he was last Attorney and I was leading the Australian Law Reform Commission.

We have our discrimination law proposals to advance – finishing the implementation of Respect@Work and working on implementing our proposals on discrimination law reform set out in our position paper that I released and spoke to on Human Rights Day in December – the first piece of the culmination of our Free and Equal project. The beauty of that paper is our recommendation to significantly shift the model to a co-regulatory scheme that rewards upstream action to prevent discrimination, and which embeds more positive actions for the Commission to work with the business community to prevent discrimination.

We are in the final stages of the second piece of our Free and Equal work, which will present a revised and revamped model for a federal Charter of Rights.

There is much to speak about!

With my very best wishes,
Rosalind
